Take A Meeting Legal Disclaimer

Final Draft, Inc. (“Organizer”) secures contractual agreements to appear from each executive before tickets are made available to meet with that person. However, one or more executives may be unable to appear or may arrive late to the event and therefore be unavailable for a purchased meeting time slot.

Organizer will have additional executives available to hear meetings in the event that any executives are unable to meet their contractual obligation If an executive does not appear, a make-up meeting will be arranged with one of our back-up executives. Make-up meetings are available in lieu of refunds. No refunds will be provided.

Organizer cannot be responsible if an executive does not meet his or her contractual obligation. Organizer reserves the right to make substitutions and changes to the event schedule, speaker roster and venue without notice.

Liability Waivers
By registering for and/or attending any classes or meetings in any capacity (including, but not limited to registrant, speaker, exhibitor) you agree that Organizer is not liable for any personal injury, death, theft or other incidents that may occur at the Take A Meeting event. Organizer is not liable for any harassing, defamatory, illegal or improper conduct or remarks by executives or speakers at the event; any infringement of your intellectual property rights by executives, speakers, agents, employees, representatives of Organizer, or any other participants of the event; or any interaction or dealings between you and the executives or speakers, or any other participant of the event, whether the same occurs at Take A Meeting or at any other time.

Refund Policy
Registration refund requests must be in writing and postmarked by August 1, 2008. All refunds we will be charged a $25.00 processing fee. No registration refunds will be issued after August 1, 2008. No refunds will be made for unused event tickets. No refunds will be issued if an attendee purchased a ticket for a meeting with an executive who was not available for the meeting if the staff of the Take A Meeting was able to provide the attendee with an executive with whom to meet in lieu of the originally selected executive.

Consumer Data Privacy Policy
When you register to participate in Take A Meeting, the registration form requires your personally identifiable contact information such as your name, telephone number, email address and postal code. By filling in this form, you are consenting to Organizer’s collecting the personally identifying information so as to register you to participate in this year's event.

Organizer acknowledges your trust and is committed to protecting the information you provide us. To prevent unauthorized access, maintain accuracy and ensure proper use of your personal information, we have employed physical, electronic and managerial processes to safeguard and secure the information we collect online. We do not sell, rent or share any of this information for any other purpose, other than noted below.

We may also receive your non-personally identifiable information which is information that does not by itself identify you specifically. The non-personally identifiable data we collect when you visit our site may include the Uniform Resource Locator ("URL") of the web site from which you came before visiting our site, which pages you visit on our site, which URL you go to next, which browser you used to come to our site, your Internet Protocol ("IP") address and any search terms entered on our site. We do not link the personally identifiable information and non-personally identifiable information we collect on our site. A cookie is a piece of information that a web site will send to your computer when you are at that site.

This information allows the site to remember necessary information that makes your use of that site more convenient. You may choose to have your computer warn you every time a cookie is being sent, accept cookies for only the originating site or you can choose to disable all cookies. You can do this through your browser (such as Netscape or Internet Explorer) settings and should view your browser Help menu to find the correct way of modifying these settings. If you choose to turn cookies off, you will not have access to many site features that make your experience and participation more efficient and other services may not work.

From time to time, we may be required to provide personally identifiable information in response to a court order, subpoena or government investigation. We also reserve the right to report to law enforcement agencies any activities that we, in good faith, believe to be unlawful. We may release certain personally identifiable information when we believe that such release is reasonably necessary to enforce or apply our Service Provider Agreement or to protect the rights, property and safety of others and ourselves. All fees for Take A Meeting are payable via a secured and recognized credit card payment site. We have no access to this information and are not responsible for any such information that you provide to that site.

Governing Law
THIS AGREEMENT SHALL BE GOVERNED BY AND CONSTRUED IN ACCORDANCE WITH THE SUBSTANTIVE LAWS OF CALIFORNIA (USA), WITHOUT REGARD TO CONFLICTS OF LAW PRINCIPLES. ANY DISPUTE ARISING OUT OF OR UNDER OR RELATING TO THIS AGREEMENT SHALL BE RESOLVED EXCLUSIVELY BY MANDATORY BINDING ARBITRATION PURSUANT TO EH THEN-EFFECTIVE COMMERCIAL ARBITRATION RULES OF THE AMERICAN ARBITRATION ASSOCIATION BEFORE A SINGLE ARBITRATOR IN LOS ANGELES COUNTY, CALIFORNIA. SUBJECT TO THE FOREGOING ARBITRATION PROVISION, THE STATE AND FEDERAL COURTS LOCATED IN LOS ANGELES COUNTY, CALIFORNIA WILL HAVE EXCLUSIVE JURISDICTION OVER ANY DISPUTE ARISING OUT OF OR UNDER THIS AGREEMENT. AND IRREVOCABLY CONSENT TO EXCLUSIVE PERSONAL JURISDICTION AND VENUE THEREIN. YOU ARE RESPONSIBLE FOR COMPLYING WITH YOUR OWN LOCAL LAWS, WHICH MAY VARY WITH RESPECT TO CERTAIN ACTIVITIES OR PEOPLE (E.G., MINORS).

Any claim arising out of or under or relating to this Agreement must be brought and maintained within one (1) year after the claim arises or be barred. The prevailing party shall be entitled to receive it legal fees and costs, including reasonable legal fees for in-house and outside counsel.

If we are required to enforce this Agreement or our rights, you agree it is reasonable to send you legal notices and papers by electronic mail at your stated address.
